Switzerland is a global hub for commodity trading and trade finance. The sale and purchase of commodities often involves multiple bilateral relationships, each one with distinct legal and commercial risks, and therefore differing best practices/solutions. In an effort to reduce the risk of subsequent costly arbitration proceedings, we often advise traders, banks and carriers at the outset as to anticipated risks, and corresponding legal solutions, to best protect them in their relationships with their counterparties. We have particular expertise in relation to commodity sale contracts (for example on various GAFTA or FOSFA forms), letters of credit, and associated carriage/shipping documents such as bills of lading.
